ICO guidance on transparency published for health and care sector

The Information Commissioner’s Office (ICO) has released new guidance aimed at improving transparency in the health and social care sector regarding the use of personal information.

The guidance, unveiled on April 15th, aims to provide clarity on how organizations can inform individuals about the use of their data. It outlines steps for assessing appropriate levels of transparency and offers practical advice on developing transparency information effectively.

According to Anne Russell, head of regulatory policy projects at ICO, transparency is crucial for fostering trust in health and social care services. When individuals understand how and why their personal information is utilized, they feel more comfortable sharing their health data for various purposes, including medical research.

Given the sensitive nature of information handled in the health sector, the guidance helps organizations grasp the concept of transparency. People have the right to know how their personal data is being used, especially when accessing critical services.

In addition to detailing how to provide transparency and privacy information, the ICO guidance emphasizes the importance of communication methods and the regular review of transparency information to ensure ongoing compliance.

Russell highlighted the significance of effective transparency as new technologies are increasingly utilized in the health sector. The guidance, informed by feedback from health and social care organizations, is designed to enhance understanding and promote honesty in the handling of personal data.

The publication of this guidance follows a public consultation earlier this year and serves as a supplement to existing ICO guidance on transparency and the right to be informed. The ICO has previously taken action against organizations that have failed to adequately protect patients’ private data.
